The defendant, Gregory Yopp, pled guilty to violating the terms of his supervised release. The district court sentenced Yopp to the statutory maximum of twenty-four months imprisonment in order to force Yopp to participate in the Federal Bureau of Prisons 500 hour drug treatment program. Yopp now appeals, arguing that his sentence is unreasonable because the district court did not consider the policy statements in Chapter Seven of the Sentencing Guidelines, that the district court failed to sufficiently consider the 18 U.S.C. § 3553(a) factors, and that the sentence was greater than necessary to provide Yopp with treatment. For the following reasons, we VACATE Yopps sentence and REMAND for resentencing.
