Defendant Lewis A. Zipkin, an attorney, was indicted and convicted of violating 18 U.S.C. § 153*fn1 by knowingly and fraudulently appropriating to his own use $6,000 belonging to Greenwood Village, Incorporated, a bankrupt estate for whom Zipkin was serving as receiver. We conclude that the district judge improperly permitted opinion testimony of a bankruptcy judge on a question of law to be introduced at trial. We further hold that the district judge erred in permitting the bankruptcy judge to interpret an order he issued in a bankruptcy proceeding. The introduction of this evidence was permitted by the district judge over the objections of defense counsel. This Court is of the opinion that the foregoing testimony was highly prejudicial and constituted reversible error. Accordingly, we reverse the conviction.
